In general lease extension premiums or the price for purchasing a freehold are agreed between the parties. Occasionally however negotiations cannot be concluded and the matter is referred to the Tribunal for determination. At the tribunal the evidence from the expert witnesses is heard and they are cross examined by a Barrister or another Surveyor. After the evidence is heard the Tribunal will consider what they have heard and make a determination. There is an option to appeal the decision to the Upper Tribunal but this is rarely taken up.
